The General Terms and Conditions of Sale govern the distance-selling relationship between SASCHA RENE ESCHBACH and the user or customer, in accordance with the applicable legal provisions, in particular Law 7/1998 of 13 April on General Terms and Conditions of Sale, Law 3/2014 of 27 March amending the consolidated text of the General Law for the Defence of Consumers and Users, Organic Law 3/2018 of 5 December on the Protection of Personal Data and the Guarantee of Digital Rights, the General Data Protection Regulation (EU) 2016/679, Law 7/1996 of 15 January on the Regulation of Retail Trade, and Law 34/2002 of 11 July on Information Society Services and Electronic Commerce.

SASCHA RENE ESCHBACH reserves the right to make any modifications to the General Terms and Conditions that it considers appropriate without prior notice. Such modifications may be made through its websites in any legally permissible manner and shall be binding for as long as they are published on the website and until they are validly replaced by subsequent modifications. However, SASCHA RENE ESCHBACH reserves the right, in certain cases, to apply Specific Terms and Conditions of Sale in preference to these General Terms and Conditions where it considers this appropriate, provided that they are duly announced. Such changes shall not affect contracts concluded prior to the date on which they are published.

The purpose of the website is the online sale of original Zippo lighters and related items.

The duration of the contract shall be linked to delivery of the product, without prejudice to the right of withdrawal.

As a user or customer, you expressly declare that you know, understand and accept the terms of use and these General Terms and Conditions of Sale. You also declare that you are of legal age, or an emancipated minor, and have the legal capacity and capacity to enter into contracts required to access the websites of SASCHA RENE ESCHBACH and conclude contracts through them.

Once the purchase process has been completed, the customer will receive an order confirmation by email. It is essential that the user provides a valid email address during the purchase process. Upon receiving the product at the delivery address provided, the customer will receive an invoice or a copy of the order. The user will be offered the option of receiving an electronic invoice subject to prior consent. Acceptance of this method of invoicing means that the invoice will be sent electronically and will have the corresponding legal effect. Subsequent invoices will be provided by this method unless otherwise indicated. Consent to receive electronic invoices may be withdrawn at any time by sending an email to the email address indicated above.

Offer and Validity

If a product is offered at a special price, its offer price and validity period will always be indicated together with its essential characteristics.

The products offered in our online shop include a photograph and their essential characteristics. This information is obtained from the respective manufacturer. The product characteristics indicate the colours in which the product is available.

Warranties

SASCHA RENE ESCHBACH is liable for any lack of conformity of all products offered on the website for a period of three years from delivery.

In accordance with the General Law for the Defence of Consumers and Users, defects appearing during the first two years in new products are presumed to have existed at the time of delivery, unless the company can demonstrate that the defect was caused by improper use.

SASCHA RENE ESCHBACH provides an after-sales service during the aforementioned period. Prices

All products display their selling price in euros and include Value Added Tax (VAT).

If any other tax is applicable, this will be indicated accordingly (IGIC or IPSI).

Delivery and Shipping Costs

Shipping costs are €10 for orders shipped within the European Union.

Products are shipped via CORREOS.

Payment Methods

The customer may pay for their order using the payment methods available during the checkout process. The following options are currently offered:

  • Shopify Payments, using the payment methods available at the time of placing the order.

  • PayPal.

  • Bank transfer (payment in advance).

The available payment methods will be clearly displayed during the checkout process and may vary depending on the customer's country, the device used and other factors.

If the customer chooses to pay via Shopify Payments or PayPal, the order will be processed once the corresponding payment has been received and confirmed.

Payment by Bank Transfer

If the customer chooses payment by bank transfer, the customer will receive the necessary bank details together with the order confirmation or in a subsequent communication.

The customer should state the order number and, where possible, their first and last name in the transfer reference in order to facilitate correct identification of the payment.

To facilitate proper processing of the order, it is recommended that the transfer be made within 3 calendar days of the order confirmation.

The order will be processed and shipped once the corresponding payment has been received and confirmed.

Delivery Period and Conditions

Orders are shipped from Spain via Correos with a tracking number. The customer will receive the tracking information once the order has been shipped.

The delivery period depends on the destination country and the conditions of the shipping service. The stated delivery times are indicative and do not constitute a guarantee of delivery on a specific date. Any delays caused by the shipping service or circumstances beyond the seller's control shall not be attributable to the seller, without prejudice to the consumer's statutory rights.

Execution and Delivery of the Order

SASCHA RENE ESCHBACH will process orders once payment has been received and, where applicable, confirmed.

Orders are shipped from Spain via Correos with a tracking number. The customer will receive the tracking information once the order has been shipped.

The delivery period depends on the destination country and the conditions of the shipping service. The stated delivery times are indicative and do not constitute a guarantee of delivery on a specific date, without prejudice to the consumer's statutory rights.

The availability of products offered by SASCHA RENE ESCHBACH may vary depending on demand. Although stock is updated periodically, exceptionally a requested product may not be available at the time the order is placed.

If a product is unavailable after the order has been placed, the customer will be informed as soon as possible and the full amount paid will be refunded or, where possible and with the customer's consent, a suitable alternative will be offered.

Right of Withdrawal

The buyer has a period of fourteen (14) calendar days to exercise the right of withdrawal without giving any reason, starting from the day on which the buyer or a third party designated by the buyer, other than the carrier, obtains physical possession of the products.

To exercise the right of withdrawal, the customer must communicate their decision to withdraw from the contract by means of an unequivocal statement. The customer may communicate this by telephone at (+34) 618 999 795, by email at info@collectorlighter.com, in writing to PD LALLACUNA 230, 46720 VILLALONGA (VALENCIA), or by using the corresponding withdrawal form.

Once the withdrawal has been communicated, the customer must return the products without undue delay and in any event no later than fourteen (14) calendar days from the date on which the customer communicates their decision to withdraw from the contract.

The customer shall only be liable for any diminished value of the products resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the products.

Once the right of withdrawal has been properly exercised, SASCHA RENE ESCHBACH shall refund all payments received from the customer, including, where applicable, standard delivery costs. The refund shall be made without undue delay and in any event no later than fourteen (14) calendar days from the date on which the withdrawal is communicated. However, the refund may be withheld until the products have been received or until the customer has provided proof of their return, whichever occurs first.

The refund shall be made using the same payment method used by the customer for the original transaction, unless another payment method has been expressly agreed.

Returns

If the right of withdrawal is exercised, the customer must return the products to SASCHA RENE ESCHBACH, at PD LALLACUNA 230, 46720 VILLALONGA (VALENCIA), without undue delay and in any event no later than fourteen (14) calendar days from the date on which the customer communicates their decision to withdraw from the contract. The deadline shall be deemed met if the customer sends the products back before the period has expired.

The customer shall bear the direct costs of returning the products, unless applicable legislation provides otherwise.

Refund of Payment

In the event of withdrawal, SASCHA RENE ESCHBACH shall refund the customer all payments received, including, where applicable, standard delivery costs, using the same payment method used by the customer for the original transaction, unless another payment method has been expressly agreed.

The refund shall be made without undue delay and in any event no later than fourteen (14) calendar days from the date on which the withdrawal is communicated. However, the refund may be withheld until the products have been received or until the customer provides proof of their return, whichever occurs first.

Return of Defective Products

If a product is defective or does not conform to the contract, the customer must notify SASCHA RENE ESCHBACH through any of the contact methods indicated in these terms and conditions.

Where the defect or lack of conformity is not attributable to the customer, the statutory warranty and conformity rights applicable shall apply. In such cases, the customer shall not bear any return costs that are legally payable by the seller.

Depending on the circumstances and applicable legislation, the applicable remedy may include repair, replacement, price reduction or termination of the contract, in accordance with the rights available to the consumer.

SASCHA RENE ESCHBACH will handle customer complaints in accordance with applicable legislation.

Applicable Law and Dispute Resolution

The contractual relationship shall be governed by Spanish law, without prejudice to any mandatory consumer protection provisions that may apply.

In the event of a dispute, jurisdiction shall lie with the courts and tribunals determined in accordance with the applicable legal rules on jurisdiction and competence, while respecting in all cases the rights afforded to consumers.
